CHINA TO SOUTH AFRICA (PTY) LTD RETURN, REFUND & WARRANTY POLICY

Effective Date: 04 December 2025

This policy applies to all goods sourced, imported, and supplied by China to South Africa (Pty) Ltd (“the Company”, “we”, “us”) to customers in South Africa (“the Customer”, “you”). It is aligned with the Consumer Protection Act 68 of 2008 (CPA) and governs all sourcing, importation, refurbished, and brand-new product transactions.

1. Scope of Application and

Definitions
China to South Africa (Pty) Ltd operates as a sourcing and international procurement company, sourcing goods mainly from China based on customer specifications.

Most products are custom-sourced, imported on request, or made to order and are therefore treated as special orders.

Returns and refunds are only permitted under the conditions stated in this Policy, subject always to the CPA.

This Policy forms part of our Terms & Conditions.

2. Deposits, Payments & Non-Refundable Terms


Once payment is made, the Customer authorises us to begin sourcing, purchasing, production, or shipping.

Once sourcing or production begins, the order becomes non-cancellable, unless required by law.

Supplier payments, sourcing fees, international shipping, customs, and clearing costs already incurred are non-recoverable.

Any refund approved will exclude irrecoverable third-party costs already paid on behalf of the Customer.

3. Conditions Under Which Returns or Refunds May Be Considered (CPA Protected)
Returns or refunds may be considered where:

Material Non-Conformity – Goods materially differ from agreed written specifications.

Manufacturing Defect – A confirmed factory defect is verified.

Direct Marketing Cooling-Off –

4. business days under CPA Section 16.

Implied 6-Month CPA Warranty (New Goods Only) – If a new product fails due to an inherent defect within 6 months, the customer may request repair, replacement, or refund as provided by law.

Defects must be reported immediately with cooperation in inspection.

4. Return & Refund Procedure
Written request required with:
• Order number
• Proof of payment
• Description of fault
• Photos/videos
• Test report if applicable

Assessment within 7 business days.

Refunds (where approved) processed within 10 business days after verification.

Refunds exclude non-recoverable international costs already incurred.

5. Repair or Replacement Before Refund Repairs or replacements may take priority.

Supplier and logistics timelines apply.

Acceptance of replacement resolves the claim.

6. Non-Returnable & Non-Refundable Circumstances


No returns/refunds for:
• Change of mind on custom/import orders
• Incorrect specifications supplied by customer
• Cosmetic damage after delivery
• Misuse, drops, water, or power damage
• Third-party repairs
• Normal wear and tear
• Clearance stock where disclosed
• Shipping or customs delays beyond our control

7. Limitation of Liability & Legal Compliance


We act as a sourcing and import facilitation agent.

Liability is limited to the transaction value where legally permitted.

This policy does not override any rights granted under the CPA.

 

8. Dispute Resolution

Disputes shall first be handled amicably.

If unresolved, matters may be referred to the NCC, Ombudsman, or a South African court.

 

9. Final Provisions
We may amend this policy at any time.

Latest version applies to all orders.

Placing an order confirms acceptance of this policy.

 

10. Refurbished Products (CPA-Compliant)

Refurbished goods include pre-owned and factory-refurbished items.

All refurbished goods are clearly disclosed as refurbished.

Sold as-is, except for major defects existing at delivery.

Only DOA or serious functional failure on arrival qualifies.

Claims must be reported within 48 hours with video proof.

Battery wear, cosmetic wear, and reduced performance are not defects under the CPA.

 

11. Warranty on Brand-New

Products (China Mainland Manufacturer Warranty)
Some new products include a manufacturer warranty valid only in Mainland China.

Customers acknowledge:
• The manufacturer warranty is not locally supported
• Warranty claims must be returned to the supplier in China
• International logistics are the customer’s responsibility

This does NOT remove the mandatory 6-month CPA warranty for defective new goods supplied in South Africa.

 

12. No Local Manufacturer Warranty Disclaimer

Unless stated in writing:
• No local manufacturer warranty applies
• Grey-import risks apply
• Region locks and network compatibility are customer responsibilities

This does not limit CPA defect protection on new goods.

 

13. One-Week Limited Functional Warranty (Store Warranty)
We provide a 7-day store functional warranty on all products.

This covers system or functional malfunctions only present at delivery.

This does NOT cover:
• Batteries
• Wear and tear
• Drops, water, power damage
• Software tampering
• Network compatibility

Claims require video proof within 7 days.

This store warranty operates in addition to statutory CPA rights.

14. CPA Compliance Notice
Nothing in this policy limits rights under the Consumer Protection Act.

Dangerous or defective goods, latent defects, and supplier liability remain governed by the CPA.
